Family Immigration & Citizenship

Family immigration is the basis of much of the United States immigration system. Indeed, nearly 70 percent of all visas issued by the American government during the average year are family-based visas. At Carrillo Law Center, our Stockton  immigration lawyer handle all types of family immigration matters, including:

  • Spousal and K-1 Fiancé(e) Visas: Marriage is one of the most straightforward paths for family immigration. Through a spousal visa or K-1 Fiancé(e), you or a loved one may be able to obtain a visa to come to immigrate to the United States. If you have questions about your rights, call our Stockton marriage immigration lawyer for help.

  • Family Preference Immigration: A non-immediate family member may be eligible to immigrate to the United States through something called family preference immigration. Although there are annual statutory caps on the total number of family preference visas, nearly 500,000 are issued nationwide each year. Contact our Stockton immigration lawyer for immediate assistance with your case.

  • Citizenship through Family: One of the advantages of family immigration is that it can provide a potential path to American citizenship. If you have been a lawful permanent resident (green card holder) in good standing for at least five years, you may be eligible to apply to become a United States citizen. Contact our Stockton immigration lawyer for immediate assistance with your case.

We know that family immigration can be complicated. There are a number of potential pitfalls that need to be avoided by people and families who are navigating the system. Immigration Representation for Investors

International investors may be able to obtain an American green card for themselves and their family members by making a qualifying investment in the United States. Our Stockton  immigration lawyers have the skills and experience to help foreign investors understand and take advantage of their available immigration options.

One of the most frequently utilized options is the EB-5 Immigrant Investor Program. Created by the United States Congress in 1990, the EB-5 Immigrant Investor Program allows foreign investors to obtain a lawful permanent resident status for themselves and their immediate family members (green cards) if they make a significant, job-supported investment in a U.S.-based project.

With extensive experience representing immigrant investors, our Stockton  immigration lawyer help people navigate the EB-5 program requirements, ensuring that they place the required amount of capital in an investment project that will actually qualify them and their family for green card status. If you have questions, call our California EB-5 investor visa lawyers for additional information.

Adjustment of Status Proceedings

As explained by United States Citizenship and Immigration Services (USCIS), the term ‘adjustment of status’ is used two describe two separate processes:

  • The change from a non-immigrant status to lawful permanent residence status; and

  • The change for permanent residence status to American citizenship.

In other words, an immigrant who is adjusting their status is either seeking to obtain a green card or seeking to apply for U.S. citizenship. At Carrillo Law Center, our Stockton, CA immigration lawyers have the skills and experience to handle all types of adjustment of status cases. We will make sure that the paperwork is completed properly so that you and your family can rest easy.

Green Card Services

Also known as a lawful permanent resident card, a green card grants an immigrant the legal authorization to reside and work in the United States on a permanent basis. Not everyone around the world is in a position to apply for a green card. You can only seek a green card if you can satisfy certain conditions and criteria. At Carrillo Law Center, our Stockton  immigration lawyer has experience helping people and families with the full range of green card issues. If you have any specific questions about the green card application process, we would be more than happy to help.

Deferred Action for Childhood Arrivals (DACA)

The Deferred Action for Childhood Arrivals program or “DACA” was created as part of an Executive Order back in 2012. The purpose of DACA is to provide a path to legal status for undocumented immigrants who were brought to the United States while they were still minors. When granted, DACA provides protection against deportation and a work permit. Notably, the federal government estimates that more than one million people nationwide are eligible for DACA protection. To obtain DACA, you must be able to satisfy the following four core requirements:

  1. You must be able to demonstrate that you have lived in California or somewhere else in the United States since at least 2007;

  2. You must be able to demonstrate that you arrived in the country prior to your 16th birthday—DACA is only for people brought to the U.S. as children;

  3. You must have a high school diploma, the equivalent of a high school diploma, or you must be actively enrolled in school or such an educational program; and

  4. You cannot have a felony criminal record.

One of the challenging things about the DACA program is that there have been many different lawsuits filed. At times, the federal government stopped accepting and reviewing DACA applications. However, as of 2021, the DACA program has been fully restored. Currently, you can apply to renew your DACA status. Further, if you are eligible for DACA but you have not yet applied, you have the right to submit a first-time DACA application. If you have any questions or concerns about the process, please get in touch with our Stockton DACA immigration attorneys for a completely confidential consultation.
