The Deferred Action for Childhood Arrivals program or “DACA” was created as part of an Executive Order back in 2012. The purpose of DACA is to provide a path to legal status for undocumented immigrants who were brought to the United States while they were still minors. When granted, DACA provides protection against deportation and a work permit. Notably, the federal government estimates that more than one million people nationwide are eligible for DACA protection. To obtain DACA, you must be able to satisfy the following four core requirements:

You must be able to demonstrate that you have lived in California or somewhere else in the United States since at least 2007;

You must be able to demonstrate that you arrived in the country prior to your 16th birthday—DACA is only for people brought to the U.S. as children;

You must have a high school diploma, the equivalent of a high school diploma, or you must be actively enrolled in school or such an educational program; and

You cannot have a felony criminal record.
One of the challenging things about the DACA program is that there have been many different lawsuits filed. At times, the federal government stopped accepting and reviewing DACA applications. However, as of 2021, the DACA program has been fully restored. Currently, you can apply to renew your DACA status.
